Question: Is it legal to prohibit an employee to take prescription medication while on the job? I work at a not for profit hospital that has in its employeee handbook that it is against policy to take any form of medication while on the clock. I have medication that has set time intervals to be taken which would require me to take while I am working. Is this a legal to prohibit to take medication prescribed by my Doctor? It is necessary to take this medication but I am in fear of losing my job if it was found out that I am not compliance with company policy? I need a definitive answer please.

Answer: It's definitely not healthy. If you have prescription meds, you have no choice but to take it. Look into whatever government section covers your workers there. You could find out about your rights. If you NEED your medication and you can't take them at your current job, it may be worth finding a new job. Your health is more important. Or, could you slip out to your car for a minute on your break and take your meds?

Answer: the main purpose of this is so the company can get a lower insurance rate. less items to start fires and cause personal injuries.

Answer: The Constitution does not give the power to prohibit intoxicants, but neither does it deny that power. People seriously misunderstand the Constitution. Something does not have to be mentioned in the Constitution to be Constitutionally legal.

Answer: The plan document is what she needs to read. I am a Pension Plan Administrator and an employer has the right to elect to not allow hardship withdrawals from a 401(k). The employer gets to make those choices when the plan is originally set up. The Plan document will specify these restrictions.

Answer: Yes on retirement at 65. You can work as long as you are healthy and your performance is acceptable.You cant be fired just because of your age. There are only a few jobs that have mandatory retirement age such as air line pilots.
There is no federal law regarding discrimination based on sexual preference. There are however some state and local laws that cover this. Some school districts have "morals clauses" which means that if you are arrested for immoral acts you could possibly face suspension or termination. I dont see where have a same sex partner would fall into this category.
